1. Scope
This Privacy Policy explains how Nukhu Media, LLC collects, uses, stores, shares, and protects information when you use nukhu.com, related subdomains, OTT applications, NuVee pages, NuPoints, NuSpots, fundraising campaigns, creator tools, theatre request features, referral tools, and other Nukhu services.
By using the Service, you agree to this Privacy Policy and the Nukhu Terms of Service.
2. Information we collect
We collect information you provide directly, information generated by your use of the Service, information from connected services, and information from vendors or partners where needed to operate the Service.
- Account and identity information, such as name, username, email address, password credentials, phone number, age-related information, account preferences, profile information, and authentication data.
- Contact and location information, such as city, state, province, ZIP or postal code, country, shipping address, billing details, and event-related contact details.
- Google or social sign-in information, such as email address, account identifier, language preference, age range, and other information you authorize. Nukhu's use of Google user data is limited to providing account access and related user features.
- Viewing and engagement information, such as NuVees viewed, purchased, played, liked, voted on, shared, added to stacks, requested in theatres, searched for, commented on, or otherwise interacted with.
- NuPoints, purchases, and payment-related information, such as NuPoint balance, purchases, transactions, campaign pledges, unlocks, payment status, transaction IDs, fraud signals, and payment processor records. Nukhu does not store full payment card numbers where a payment processor handles them.
- Creator and studio information, such as submitted films, trailers, stills, captions, credits, cast and crew information, metadata, studio details, payout details, tax information, rights confirmations, and campaign application materials.
- Fundraising and perk information, such as pledges, tier selections, supporter display names, anonymous preferences, fulfillment addresses, event RSVPs, scheduling preferences, accessibility notes, campaign updates, comments, and backer history.
- NuSpot advertiser information, such as advertiser contact information, business details, campaign settings, ad creative, billing status, bid settings, engagement data, and campaign reporting.
- Ambassador and referral information, such as referral IDs, affiliate links, cookies, attribution data, shared links, reward records, payout information, and promotional activity.
- Device, usage, and technical information, such as IP address, browser, device type, operating system, pages visited, event logs, cookies, pixel tags, web beacons, referring URLs, app routes, timestamps, and diagnostic data.
3. How we collect information
We collect information when you create an account, sign in, upload content, submit films, buy or earn NuPoints, unlock NuVees, back campaigns, request screenings, comment, share, search, join programs, submit NuSpots, use referrals, contact support, respond to surveys, or otherwise use the Service.
We may receive information from payment processors, authentication providers, analytics providers, advertising tools, email vendors, hosting providers, fraud prevention vendors, social platforms, FilmFreeway, foundation-approved donation processors, or other services you choose to use.
4. How we use information
We use information to operate, provide, secure, customize, improve, and support the Service.
- Create and manage accounts.
- Process NuPoint purchases, NuVee unlocks, campaign pledges, creator payouts, advertiser payments, and ambassador rewards.
- Host, display, publish, promote, subtitle, caption, and support NuVees and related pages.
- Operate campaign fundraising, escrow, relaunch notices, tier selection, perk fulfillment, updates, comments, and backer records.
- Operate NuSpot advertising, ad sessions, campaign measurement, and advertiser reporting.
- Operate referral, ambassador, affiliate, and share-link attribution.
- Personalize discovery, recommendations, language preferences, parental or maturity settings, and platform experiences.
- Provide customer support, administrative notices, legal notices, security alerts, marketing emails, newsletters, and transactional messages.
- Detect, investigate, and prevent fraud, abuse, spam, security incidents, payment issues, rights disputes, policy violations, and illegal activity.
- Comply with legal, tax, accounting, rights, and regulatory obligations.
6. Campaign, creator, and perk information
Campaign pages may publicly display information such as creator name, studio name, title, goal, progress, backer counts, supporter names if enabled, anonymous support preferences, updates, comments, cast, crew, perks, and funding status.
If you choose a perk that requires fulfillment, we may share only the information reasonably needed to fulfill that perk with the creator, studio, vendor, venue, or partner responsible for delivery.
8. Marketing communications
Nukhu may send transactional, account, security, campaign, creator, platform, relaunch, referral, and administrative communications. Nukhu may also send newsletters or marketing messages where permitted.
You may unsubscribe from marketing emails by following the instructions in the email or by emailing unsubscribe@nukhu.com. Some transactional or account-related messages may still be sent even if you opt out of marketing.
9. Data storage and retention
Nukhu uses cloud hosting and storage providers, including AWS infrastructure in the United States. We retain information for as long as needed to provide the Service, maintain your account, comply with legal obligations, resolve disputes, maintain rights and accounting records, prevent fraud, enforce terms, and operate campaigns, payments, and creator records.
If you close your account or request deletion, Nukhu may delete or de-identify information where appropriate, but may retain records needed for legal, tax, accounting, payment, security, fraud prevention, rights, campaign, payout, or dispute purposes.
10. Security
Nukhu uses reasonable administrative, technical, and organizational measures designed to protect information. No method of transmission or storage is completely secure. Nukhu cannot guarantee that information will never be accessed, used, or disclosed without authorization.
11. Your privacy choices and rights
Depending on where you live, you may have rights to request access, correction, deletion, portability, restriction, objection, opt-out of certain processing, or information about how your data is used. You may contact privacy@nukhu.com or call 631.924.7330 to make a request.
We may need to verify your identity before responding. We will respond within the timeframe required by applicable law. You may also update certain account information directly through account settings where available.
12. U.S. state privacy notice
Some U.S. state privacy laws may provide rights to know, access, delete, correct, port, or opt out of certain data practices. Nukhu does not sell personal information for money. Some advertising or analytics activities may be considered sharing, targeted advertising, or cross-context behavioral advertising under certain state laws. You may contact privacy@nukhu.com to exercise available rights or ask questions about opt-out options.
13. European and UK privacy notice
If European or UK privacy law applies, Nukhu may process personal data based on contract necessity, legitimate interests, consent, legal obligations, or other lawful bases. You may have rights to access, correct, delete, restrict, object, withdraw consent, or request portability. You may also have the right to lodge a complaint with a supervisory authority.
14. Children
The Service is not directed to children under 13. Nukhu does not knowingly collect personal information from children under 13. If Nukhu learns that it has collected personal information from a child under 13 without appropriate consent, it will take steps to delete the information.
15. International users
The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, and processed in the United States or other countries that may not provide the same level of protection as your home jurisdiction.
16. Third-party links and services
The Service may link to or integrate third-party websites, platforms, processors, donation pages, social networks, OTT platforms, or tools. Their privacy practices are governed by their own policies, not this Privacy Policy.
17. Changes to this Privacy Policy
Nukhu may update this Privacy Policy from time to time. Updates will be posted on the Service with a new last updated date. Your continued use of the Service after an update means you accept the updated policy where permitted by law.
